Hi there JMASTERFLEX,
The answer to your question is: Yes!
We bought a duplex last year so we're going through this also (the fence stuff that is)
You are allowed to build a 4-Foot high fence without any permits or other pre-approval. If you want one taller, then you must get a permit from the town. In order to get the permit you must have you're neighbors' permission.
What this means is that you they sign a waiver / variance form that is then submitted to the town. You are required to get the signatures of every neighbor that the fence is going to face. Usually, this means 3 signatures – each side of your house, and the people who live behind you. You then drop this off at the town hall, (ask for Chris), and the town council will vote on it. (I’m not sure on this but if you want your fence to be taller than 6-feet, then it might be an issue. Most people get a 6 foot to divide the duplex side, and some even go with only a 5-foot fence.) After the mayor and town council vote on it, you go back to get the permit, pay the fee (plan for between $40 - $60) and then installation can begin.
Other useful tidbits:
The fence MUST be at least 3 Inches from the property lines,
I was also told the “Good Side” has to face out. – So make sure it’s reversible
The duplexes are small lots in the back, so check how the vertical picket pieces are mounted, (routed in the center or mounted outside of the horizontal beams) it can visually start to cut the feel of the yard, and every few inches count in a small space.
