Justices Stevens, Souter, Bader-Ginsburg, Briar and Kennedy were the majority. Chief Justice Rehnquist, Justices O'Connor, Scalia and Thomas were the dissenters.
Justice O'Connor wrote the dissenting opinion. She had some very acute statements about opening the door for potential abuses. One of her examples is directly relevant to the Anderson Avenue redevelopment initiative. "Under the banner of economic development, all private property is now vulnerable to being taken and transferred to another private owner, so long as it might be upgraded." This may force me to finally paint my fence, because someone may not like it and recommend my house for the site of the area's next Super Cuts.
Now watch someone bozo extend this to matters like euthenasia. Imagine hearing this statement from your doctor: "When property use is beyond its maximum economical function it is condemned and something new goes up. Well, you are too sick for us and we just have to 'let you go.'" In my mind, it's essentially the same thing.
I'm surprised about this split and I guess I shouldn't be. Usually it's the conservatives one would associate with business and economical motivators and the liberals one would associate with direct consequences to individuals, particularly those of low to moderate income.
